48 attorneys general (“AG”) from States (except Alabama and California) and 2 AG from US territories (Puerto Rico and D.C.) launched an antitrust investigation on Google. Simultaneously they opened antitrust investigations about Facebook in 8 US states and 1 US territory. 2 Tech-giants’ anti-competitive behaviors that stifled competition, restricted access and harmed consumers, will be investigated.
State-level investigations are expected to focus on consumer harm arising from:
- Market access problems in digital advertising,
- Price increase in digital advertising,
- Non-rational prioritization of search engine results.
These conducts have been investigated and fined by the European Commission recently.
Similarly, Facebook will be investigated at the state-level for the potential harm resulting from the following alleged conducts:
- Creating anti-competitive risks about consumers’ data,
- Stifling consumer’s choices and reducing the quality,
- Price increase in digital advertising.
