EUROPEAN COMMISSION OPENED AN INVESTIGATION INTO POSSIBLE ANTICOMPETITIVE BEHAVIOUR BY EPEX SPOT

The European Commission has opened an investigation to evaluate whether the power exchange EPEX Spot has been taking advantage of its dominant position to hinder the activities of competitors on the market for electricity intraday trading facilitation services in at least six Member States.

The investigation focused on concerns that EPEX Spot may have adopted behaviors aimed at foreclosing its competitors by reducing the ability of their customers to access the intraday market. Intraday markets are markets where sellers and buyers of electricity can trade power in the last hours before it is injected into the network.

If proven, this behaviour may constitute an abusive of dominant market position as prohibited under Article 102 of the TFEU. This behaviour may lead to higher electricity prices for consumers. The Commission will carry out its in-depth investigation as a priority.
