Payments made for online advertising services which are provided on social media websites and search engines non-operated in Turkey such as Google, Twitter and Facebook etc. are included in the scope of withholding tax through the Resolution of the President No. 476 (“Resolution”), published in the Official Gazette dated December, 19 2018 and numbered 30630.
As the above-mentioned medias have become commercial and economic vehicles, actions operated on relevant Medias are required to be under the control and supervised in accordance with the Governments’ legal systems in terms of personal data protections and other relevant issues. In this regard, governments, international institutions and organizations have started to take related actions and legislate regarding mentioned issues.
Henceforth, payments made for those who provide online advertising services and/or are agents for online advertisings services are included in the scope of withholding tax regardless of whether they are taxpayers or not. In this context, it could be said by considering recent cases that, social media firms and other organizations perform their activities on the internet are likely to be subject to varied similar regulations and rules etc. in the forthcoming days.
