THE NETHERLANDS: EXPANSION OF THE TOGS SCHEME: NON-FOOD ENTREPRENEURS CAN ALSO SUBMIT APPLIATIONS

Additional groups of entrepreneurs in the non-food sector, such as retailers, will also be able to use the Entrepreneurship Affected Sectors COVID-19 (TOGS) scheme from Monday 30 March 2020. The TOGS is specifically intended for companies that are directly affected by government measures in the fight against the corona virus. Under the TOGS scheme, entrepreneurs can receive an one-off net allowance of 4,000 euros to pay their fixed costs.

Where and when can the enterpreneur apply to use the Entrepreneur Affected Sectors Allowance COVID-19 (TOGS)?

Applications can be submitted by entrepreneurs via rvo.nl/tegemoetkomingcorona from Friday, March 27, 2020 to Friday, June 26, 2020. The company must be established in the Netherlands and the main activity must be evident from the registration of reference date March 15, 2020 in the trade register. Payment will be made as soon as possible after the application has been submitted.

Which sector can apply for the scheme Entrepreneurs Affected Sectors COVID-19 (TOGS)?

Entrepreneurs in the sectors below can apply. These are entrepreneurs who are directly affected by the measures taken by the government to combat the corona virus.

The following branches en sectors can apply for the TOGS-scheme:

  • Food and beverage outlets: e.g. restaurants, cafeteria, event catering, cafes
  • Hair and beauty care: hairdressers, pedicures, make-up artists, among others
  • Event locations and organizers
  • Saunas, solariums, swimming pools, fitness centers, sports clubs and sporting events
  • Certain private cultural institutions, such as museums, circuses, theaters, theaters, cinemas and cultural education institutions
  • Driving school owners
  • The travel industry, such as travel agencies and tour operators
  • Casinos

As a result of the expansion of the TOGS scheme the list of branches and sectors will be updated.

 

What do enterpreneurs have to meet in order to use the TOGS?

  • The company must be founded en registered before March 15, 2020 and is registered in the Chamber of Commerce Trade Register.
  • The main activity of your company was registered on March 15, 2020 under one of the required Chamber of Commerce SBI codes.
  • The company has a physical location in the Netherlands. This business address is registered in the Chamber of Commerce Trade Register.
  • Non-hospitality companies declare to have at least one establishment with a different address than the private address of the owner / owners. In these companies, the private address of the owner / owners may therefore not be the same as the business address.
  • Catering companies with SBI codes 56.10.1, 56.10.2 and 56.30 are not included. They declare in any case to rent, lease or own one catering establishment. With these companies, the private address of the owner / owners may be the same as the business address.
  • The allowance is a one-off € 4,000 per company. The allowance is therefore not per location.
  • Enterpreneur must declare that he or she has not received more than € 200,000 in public support for the current and past 2 tax years (de minimis regulation). Has the company already exhausted the entire amount of € 200,000? Then enterpreneur is not eligible for the scheme.
  • Enterpreneur expects a loss of turnover of at least € 4000 in the period from March 16, 2020 (day after the announcement of the first emergency measure) to June 15, 2020.
  • Enterpreneur has at least € 4000 in fixed expenses in the period from March 16, 2020 (day after the announcement of the first emergency measure) to June 15, 2020.
  • The company employs a maximum of 250 employees. This is evident from the registration in the Chamber of Commerce Trade Register.
  • The related company is not a public company.
  • You must provide a bank account number in the name of the company when submitting the application.
  • The company is not bankrupt.
  • Enterpreneur has not filed a petition for suspension of payments with the court.
