TURKISH COMPETITION AUTHORITY HAS DECIDED THAT THE ARTICLE 4 VIOLATED IN THE AIR CONDITIONING SECTOR

Turkish Competition Authority (TCA) finalized the investigation against an undertaking operating in air-conditioning industry. TCA found violation regarding vertical agreements of the undertakings signed with its dealers and imposed administrative fine. Additionally, TCA stipulated that following provisions present in the vertical agreements should be adapted to Block Exemption Communiqué on Vertical Agreements (Communiqué No. 2002/2):

• The provision that allows resale price maintenance,
• The provision arranging the duration of non-compete clause,
• The provision designed as; “Dealer cannot sell products to customers that are declared to be unable to sell products by the undertaking.”
