UK competition authority CMA has warned Hanson UK, a cement producer, with the aim of recurrence, about 3 breaches of Article 3.2. of the Cement Market Data Order 2016. In 2016, CMA put the prohibition on disclosing Individual Cement Market Data for preventing the prediction of cement producers’ competitors’ sales volumes. Accordingly, Article 3.2 prohibits cement producers from disclosing individual Cement Market Data except in specified circumstances. Hanson made a payment in error to the Mineral Products Association (MPA) which involved 3 pieces of information being disclosed:
- a payment relating to subscription fees
- remittance advice related to the above payment
- an invoice related to the above payment
Hanson explained that this disclosure was caused by an administrative error. Hanson also has engaged with the CMA and has taken voluntary actions to prevent a recurrence. Following this cooperation, CMA has decided not to take formal enforcement action but in the future CMA will monitor Hanson’s compliance closely. (CMA – 25.11.2020)
