ASSESSMENT OF CONSEQUENCES OF LOSS OF DUTCH NATIONALITY

Former Dutch nationals who have lost Dutch citizenship and citizenship of the EU since 1993 may be able to regain them. An online tool helps this group of Dutch people to determine whether they have indeed lost their Dutch citizenship. In that case, they can request a so-called proportionality test.

On February 12, 2020 and May 20, 2020, the Council of State determined that the Dutch government must investigate the concrete consequences if someone loses EU citizenship.

If the national government decides that the consequences of the loss of EU citizenship are disproportionate, then the person will have the Dutch nationality with retroactive effect. This investigation and opinion of the national government is called the proportionality test. The national government will only carry out the proportionality test at request if the person:

  • has applied for a Dutch passport or Dutch identity card at an embassy or consulate.
  • Dutch nationality has been lost:

- because the person lived outside the Netherlands, the European Union, Aruba, Curaçao or Sint Maarten for more than 10 years; or

- because the person voluntarily obtained another nationality and at the same time this person already had a Dutch nationality.

  • The person did not have the nationality of another EU country at the time.
  • This person must prove that the loss of EU citizenship has had disproportionate consequences for him or her.
