AUTORITÉ DE LA CONCURRENCE IMPOSED URGENT INTERIM MEASURES ON GOOGLE

Autorité de la Concurrece (Autorité), the French competition authority, has imposed urgent interim measures on Google for abusing its dominant position regarding neighbouring rights.

Publishers and news agencies have to comply with Google’s conditions due to Google’s large redirected traffic to their pages. The Autorité decided to impose urgent interim measures to protect the publishers and news agencies’ businesses from the consequences of Google’s behaviors and other search engines’ potentially abusive practices as such;

  • Imposing unfair trading conditions, by which Google does not engage in negotiation and remuneration with publishers and news agencies,
  • Circumvention of the law by not paying remuneration to any protected content,
  • Implementing a discriminatory practice to economic actors with different situations by treating same way and imposing zero remuneration on all publishers.

The Autorité imposed interim measures that will enable publishers and news agencies to negotiate with Google in good faith on the terms of re-use and display of their content, remuneration.
