The Constitutional Court clarified that an entity may be represented in commercial court by its employees that do not have a law degree, provided these representatives are company’s founders (shareholders) or are other ways associated with it.
To realize this opportunity, at least one more representative with a law degree or an advocate shall participate in the case.
The Court pointed out: often, to provide qualified assistance, not only legal, but also other special education is required. For instance, in tax disputes, both a lawyer and chief accountant are needed.
In addition, the Court emphasized that it is rather difficult or impossible to involve the named persons in a different procedural status, since they are directly or indirectly interested in the outcome of the case.
