COMPETITION AUTHORITY FINE IMPOSED ON GOOGLE FOR VIOLATING COMPETITION LAW

Our announcement regards the investigation conducted by Turkish Antimonopoly Committee on Google and its affiliates.

Competition Law is in effect in Turkey for over twenty years and Turkish Antimonopoly Committee (“TAC”) which is established as quasi-judicial agency, and authorized to conduct investigations ex officio as well as acting in accordance with received complaints.

In this respect, TAC initiated an investigation on Google LLC, Google International LLC and Google Reklamcılık Ltd. Şti. with the suspicion of violating competition legislation in the sphere of software for mobile phones. As the European Commission decided to fine Google for 4.34 billion euro ($5.04 billion) over "illegal restrictions on the use of Android” in July 2018, TAC also ordered to restrain the anti-competitive practices of Google and its affiliates.

In the statement, TAC said “Google LLC, Google International LLC and Google Reklamcılık Ltd. Şti. have violated 4054 numbered Law on the Protection of Competition with practices that obliges device producers to install Google search engine and Google applications to devices exclusively and set Google web view component as default”.

In addition to abovementioned explanations, TAC granted a term of respite for six months to Google LLC, Google International and Google Reklamcılık Ltd. Şti, in order to fulfill required changes to provide effective competition in the market and to end the violation.
