THE CIVIL CODE WILL BE AMENDED WITH A NEW IP OBJECT

A law amending the Civil Code has been published, introducing July 27, 2020 a new object of intellectual property rights. From that moment it will become possible to register a geographical indication (GI). The new concept is similar to the already existing appellation of origin of goods (AOG), but has significant differences.

A GI is a designation that identifies goods originating from the territory of a geographical location. Its quality, reputation or other characteristics are largely related to the place of its origin, where at least one of the stages of production of the goods should be carried out, which significantly affects its characteristics. While in the case of AOG, all stages of production should be carried out at the place of origin of goods.

One or more individuals, as well as legal entities and associations will be allowed to register a GI, provided the procedure for the establishment and activities of such associations do not contradict the legislation of the country of origin of goods.

To register a GI, applicants will be required to submit their papers to Rospatent. The application shall specify the product, its characteristics, a description of the production method and other data. It shall be supported by documents confirming the stated information.
