TURKISH COMPETITION AUTHORITY GRANTED NEGATIVE CLEARANCE TO THE PROTOCOL BETWEEN MOBILE NETWORK OPERATORS

Turkish Competition Authority (TCA) granted negative clearance to the “Protocol on the Collection of Annual Fee in Prepaid Mobile Subscriptions” signed between mobile network operators.
The notified Protocol which is signed by all mobile network operators in Turkey, regulated the collection of annual fees regarding prepaid mobile subscriptions paid up front by operators, which cannot be collected from subscribers due to the mobile number portability procedure (MNP). Accordingly;
- The Protocol has no provision that affect the market decisions of the parties,
- The information exchange envisaged under the Protocol is not making the market more transparent and won’t cause coordinated effects, and most of the information subject to the exchange is already obtained by the operator who incorporates the customer performing the MNT procedure under the MNP Regulation and this information is not competitively sensitive.
Eventually, TCA granted a negative clearance to the notified Protocol.
